These terms govern your use of TCMEAST when you visit from Europe or the Americas. Member accounts and e-commerce are not available yet; related sections are placeholders for future launch.
Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of www.tcmeast.com and related services operated by TCMEAST ("we", "us", or "our").
By accessing or using the site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site.
These Terms are intended for users accessing our services from Europe or the Americas. If mandatory local law gives you rights that cannot be waived by contract, those rights prevail to the extent applicable.
Scope and eligibility
Today, TCMEAST primarily provides informational content about traditional Chinese medicine and wellbeing. Some features described in these Terms (such as member accounts or online purchases) may not yet be available; we will update these Terms before or when those features launch.
- You must be able to form a binding contract under the laws of your jurisdiction.
- You must not use the site if you are barred from doing so under applicable law.
- If you are under the age required in your region to consent to online services (for example, under 16 in many European countries or under 13 in parts of the United States), you may use the site only with permission and supervision of a parent or legal guardian.
Accounts (when available)
When member registration becomes available, additional rules will apply:
- You must provide accurate registration information and keep it up to date.
- You are responsible for safeguarding your login credentials and for activity under your account.
- You must notify us promptly at contact@tcmeast.com if you suspect unauthorized access.
- We may suspend or terminate accounts that violate these Terms or pose security or legal risk.
Processing of account-related personal data is described in our Privacy Policy.
Acceptable use
You agree not to misuse the site. For example, you must not:
- Break applicable laws or infringe others’ rights.
- Attempt unauthorized access to our systems, accounts, or data.
- Introduce malware, scrape or overload the service, or interfere with normal operation.
- Use the site to send spam or misleading health claims that could cause harm.
- Copy, redistribute, or commercially exploit site content except as permitted by law or with our prior written consent.
Health and medical disclaimer
TCMEAST provides educational and cultural information about traditional Chinese medicine and wellbeing. It is not a medical provider.
Content on the site is for general information only and does not constitute medical advice, diagnosis, or treatment. Always seek advice from a qualified healthcare professional for medical conditions.
Do not disregard professional medical advice or delay seeking it because of something you read on TCMEAST.
Emergency situations require immediate contact with local emergency services, not use of this website.
Intellectual property
The site, its design, text, images, logos, and other materials are owned by TCMEAST or its licensors and are protected by intellectual property laws.
You may view and print pages for personal, non-commercial use. Any other use requires our prior written permission unless permitted by law.
User content (if enabled in the future)
If we enable reviews, comments, uploads, or other user-generated content, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and reproduce that content for operating and promoting the service, subject to our Privacy Policy.
You represent that you have the right to submit the content and that it does not violate these Terms or third-party rights. We may remove content that we reasonably believe is unlawful, harmful, or inconsistent with these Terms.
Third-party links and services
The site may link to third-party websites or services (for example, analytics or advertising providers). We do not control and are not responsible for their content or practices. Your use of third-party services is at your own risk and subject to their terms and policies.
Privacy and cookies
Our Privacy Policy explains how we handle personal information. Our Cookie Policy explains how we use cookies and similar technologies.
By using the site, you acknowledge that you have had the opportunity to read those policies. Cookie choices for non-essential tracking are managed through Cookie Settings where applicable.
Suspension and termination
We may modify, suspend, or discontinue any part of the site at any time.
We may restrict or terminate your access if we reasonably believe you have violated these Terms or if required for security, legal compliance, or protection of users and the public.
Provisions that by their nature should survive termination (such as disclaimers, limitations of liability, and governing law) will survive.
Disclaimers
The site and content are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by applicable law, TCMEAST and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the site.
Where liability cannot be excluded, our total aggregate liability for claims relating to the site will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) one hundred U.S. dollars (USD 100), except where mandatory law requires otherwise.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless TCMEAST from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the site, your violation of these Terms, or your violation of any law or third-party rights.
Governing law and disputes
These Terms are governed by the laws applicable to TCMEAST’s place of establishment, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence require otherwise.
If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory local protections, you may also benefit from rights and remedies under the laws of your habitual residence.
Before formal proceedings, please contact contact@tcmeast.com so we can try to resolve the issue informally. If a dispute cannot be resolved, courts or tribunals with competent jurisdiction under applicable law may hear the matter.
Nothing in these Terms limits your right to lodge a complaint with a data protection authority where applicable.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top will change when we do. Material changes may be posted on the site; for registered members we may also notify you by email when accounts are available.
Continued use after changes take effect constitutes acceptance of the updated Terms where permitted by law. If you do not agree, you must stop using the site (and close your account when applicable).
